DTSC Permit Decision Reports

Senate Bill 158 – Effective July 12, 2021

New Permit Decision Deadlines and Report Requirements

The reforms of DTSC’s Permitting Division that were included in SB 158 (2021) included a requirement that DTSC expedite decisions on hazardous waste facility permits. For hazardous waste facility permits expiring before January 1, 2025, permit decisions were due on July 12, 2024, or three years after permit expiration date (whichever is later) (HSC 25200).

Anytime a permit decision is not issued by the deadline, DTSC is required to issue a public report that includes the reasons why the final hazardous waste facilities permit was not made on time and a proposed schedule for permit decision, among other information (HSC 25200.25).

New Hearing Requirements (25200.27)

DTSC is required to request BES to schedule a hearing so the Permitting Division can present the report. The initial report is required to be released to the public by September 10, 2024. At a public hearing, the BES will decide to accept or modify the proposed permit schedule in DTSC’s report.

Facility Briefs and Public Comments

The facilities listed in DTSC’s report will have an opportunity to file a written brief to BES in response to the report. BES will also receive public comment during this same period.
