About the Board

Governor Newsom’s historic budget in 2021 included important environmental justice proposals to create safer, healthier communities. Along with significant investment into the cleanup and restoration of contaminated land in vulnerable communities, SB 158 implemented key governance and fiscal reforms to improve the Department of Toxic Substances Control’s (DTSC) transparency, accountability, and fiscal stability. This included the appointment of a five-member Board of Environmental Safety, comprised of a full-time chairperson and four part-time paid members. Three members of the Board are appointed by the Governor with Senate confirmation and two members appointed by the Legislature. The Board will increase DTSC’s public transparency and accountability and give communities an opportunity to engage in new and meaningful ways on hazardous waste management.

The Board is required to meet six times per year, with three meetings held directly within impacted communities across the state. It will be responsible for aligning fees with legislative mandates on an annual basis, hearing and deciding appeals of hazardous waste facility permit decisions, providing opportunities for public hearings on permit and remediation decisions, reviewing and approving the Director’s annual priorities and adopting performance metrics, developing long-term goals for DTSC’s programs and conducting an analysis of its fee structure.

The Board will also analyze DTSC’s programs and relationship to related programs to determine if duplication or overlap of work exists.
